Consequences
Under the provisions of S.35 of the Road Traffic Offenders Act 1988 the Court must order the driver be disqualified for a period not less than 6 months (12 months or more if it is a second disqualification).
Options
The Court now has the power to find in certain circumstances that hardship would be suffered by the individual concerned or by others associated with them. If established to the Court’s satisfaction, despite the existence of 12 points or even more, disqualification can be avoided or a period less than six months imposed and the licence effectively ‘wiped clean’.
